Pearson, Simon & Warshaw, LLP ("PS&W") represented the plaintiff class in litigation related to Apple, Inc.'s first generation iPod Nano. Plaintiffs alleged that the first generation iPod Nanos are defective because normal and ordinary use will result in the product becoming excessively scratched. They also alleged that Apple, Inc.'s marketing of the product was unfair and misleading because it failed to advise consumers of this defect. On April 28, 2009, the Court granted final approval of a class settlement whereby Apple, Inc. will pay $22.5 million to pay claims of class members. The deadline to submit claims was June 10, 2009.
