Toyota Prius and Lexus HS250h Antilock Brake (ABS) Class Action Lawsuit

On February 5, 2010, Pearson, Simon, Warshaw & Penny, LLP filed a class action lawsuit on behalf of a proposed class of California owners of the 2010 Toyota Prius and Lexus HS250h.  The complaint alleges that the Toyota Prius and Lexus HS250h have a design defect in the antilock braking system (ABS) causing a public safety issue.  The complaint further alleges that Toyota implemented a proposed fix to this defect on the January 2010 production cycle without notifying or repairing the model year 2010 vehicles manufactured in 2009.  

As of February 4, 2010, The National Highway Traffic Safety Administration (NHTSA) received 124 reports from consumers that while driving the 2010 Toyota Prius they experienced, "momentary loss of braking capability."  See NHTSA's press release
